Samuelson Law Firm: Seeking Justice for the Accused
It's a scenario that happens to far too many people. They went out
with a few friends, attended a party or were socializing with coworkers.
They had one or two drinks, got into the car, buckled up and headed home.
Before they know it, there are flashing lights in the rearview mirror
and soon after a police officer is reading them their Miranda Rights and
they're being arrested for an alleged DWI. While drunk driving is
a serious hazard on the road, it is important to remember that it is not
illegal to have a drink and drive – it is only illegal to drive
if you are actually under the influence.
As Houston DWI lawyers, my firm does not condone drinking and driving,
however, we are avid supporters of justice. We are dedicated to ensuring
that innocent people do not get falsely arrested and convicted. Our criminal
justice system is far from perfect and there are many flaws which can
lead to a perfectly sober person becoming arrested even though they did
nothing wrong. For instance, many law enforcement officers are not properly
trained in detecting intoxication and administering the proper tests.
They can therefore entirely botch the field sobriety tests or breath tests
and can create falsely incriminating evidence.
Another common issue in these types of tests is the equipment that is used
can be faulty, improperly maintained or abused. Say someone is pulled
over and given a breath test with a machine that has not been calibrated
per standard for months. The machine could be completely faulty and no
one would be the wiser. Therefore, someone could give a breath sample
of 0.08 percent even if that's not a true reflection of their
BAC. Even with the more accurate blood tests, the simplest mistake could create
a completely different outcome. Say a technician is tired or undertrained
– either could jeopardize the results.
At my firm, I am fully aware of the oversights and flaws in the criminal
justice system and have seen how they can result in wrongful arrests.
Therefore, I remain committed to ensuring that those I work with have
the thorough and efficient defense that they deserve. No matter the circumstances
of their case, I will always invest the necessary time and energy into
investigating the facts of the case and helping to craft a defense strategy
that is personalized to their case – providing them with the best
chance of justice that I can.
